There is no shortage of "IT companies." There are very few that understand what it means when a discovery order requires you to produce data you can't find, or when a state bar investigates whether your security practices met the standard of reasonable care. We do this work because the stakes deserve it.

The Standard

What your bar already expects from you.

Modern bar associations don't treat data security as an optional best practice. They treat it as a duty. And duties, when missed, have consequences that follow attorneys for the rest of their careers.

The conversation around cybersecurity in legal practice has shifted dramatically in the last decade. Where firms once viewed IT as a back-office expense, today's regulators, judges, and clients view it as a professional responsibility, and frankly, a competence issue.

The American Bar Association's Model Rule 1.6(c) makes this explicit: a lawyer shall make reasonable efforts to prevent the inadvertent or unauthorized disclosure of, or unauthorized access to, information relating to the representation of a client. Most state bars have adopted parallel rules. Some have gone further with specific data breach notification requirements.

Below are the realities that drive every architectural decision we make. We've put them in plain language because the consequences are plain. We invite you to share these with your managing partner. These should be conversations your firm has had, on the record.

Rule One

The Duty of Technological Competence

Comment 8 to ABA Model Rule 1.1 requires lawyers to keep abreast of changes in technology relevant to their practice. Forty-plus states have formally adopted this. "I'm not a tech person" is no longer a defense. It's an admission.

Rule Two

Reasonable Efforts to Safeguard

Under Model Rule 1.6(c), the obligation isn't perfection, it's reasonableness. But reasonableness in 2026 includes endpoint protection, encrypted backups, multi-factor authentication, and a documented incident response plan. The bar's bar keeps rising.

Rule Three

Notification & Disclosure Duties

Most jurisdictions now require lawyers to notify affected clients of breaches involving their confidential information, sometimes within days. The state attorney general may need to be told. Some breaches make headlines whether you want them to or not.

Rule Four

E-Discovery & Spoliation

Federal Rule of Civil Procedure 37(e) authorizes sanctions for failure to preserve electronically stored information. Adverse inference instructions, monetary sanctions, and case-dispositive sanctions are all on the table when a firm can't produce what it was supposed to keep.

Trust Account & IOLTA Data

Your client trust account records aren't just sensitive, they're audited. A failure in their integrity is a failure to your clients, your bar, and the state. The IT systems handling them are not the place for "good enough."

Adam Fomotor

Can you trust the kid down the street to fix your computer? Yes you can. Adam grew up in a typical California neighborhood with kids occupied by gaming and parents confused by their computers. In true entrepreneurial fashion he cast aside the less-inspired opportunities of dog walking and car washing, and instead set his sights on computer building, repair and security.

Receiving outstanding mentoring and education while securing his B.S. degree at UC Riverside, specializing in computer science and artificial intelligence, opened doors to rare opportunities. He was designing and installing multi-station computer labs even before crossing the stage in 2005 to get his diploma.

Adam's Story

From data recovery specialist to law firm engineer.

What started as a frustrating trip to a large computer repair retailer that rendered his new computer unbootable at the hands of an ill-trained technician ended up being his Call to Action. He swore he would never let that happen to him again, or to anyone else as long as he had anything to do with it.

Post-graduation he moved to the West Los Angeles area, where he found a niche servicing all brands and makes of computers. Due to the resilience of the Mac, he discovered a multitude of entertainment industry professionals seeking data recovery on their out-of-warranty devices. He became a Data Recovery Specialist who thrived on the challenge of removing a Mac's 62 screws while the customer watched, diagnosing the problem and completing the job faster than expected.

For the last decade plus, Adam has been involved in larger, more sophisticated opportunities with Agile EM that utilize his extensive experience, knowledge, speed, and accuracy. He may have started out fixing computers, but now he's accountable for maintaining and supporting corporate networks where entire IT infrastructures are in his hands, and he loves it.

Questions Managing Partners Actually Ask Us.

Section One

Onboarding & Transition

How long does it take to fully onboard a new firm?
Two months. Onboarding is intensive, we map your environment, document everything, deploy our tooling, harden security, and train your team. We charge two months of service for onboarding because that's what the work actually costs. We've found that anyone who discounts it ends up regretting it, and so do their clients.
We already have an IT person or vendor. How does the transition work?
Carefully. Most of our clients come to us from another provider, and we treat the handoff with respect, for them and for you. We coordinate access, knowledge transfer, and documentation in a way that minimizes risk during the transition. Most transitions complete cleanly within 30 to 45 days.
Do you work with solo practitioners?
Sometimes. Our minimum engagement is three users, so a solo practitioner with a paralegal and a part-time assistant qualifies. Below that, we'd refer you to one of our trusted partners who specialize in single-user environments.

Security & Compliance

Are you compliant with ABA Model Rule 1.6(c)?
Compliance with Model Rule 1.6(c) is, of course, your obligation as the attorney, not ours. What we do is build the infrastructure and document the practices that make demonstrating compliance straightforward. Every Advanced Cybersecurity engagement produces a written posture document that you can hand to your bar association or insurance carrier on request.
What happens if our firm experiences a breach?
First: we have a documented incident response plan for every client. Second: we activate it. We isolate affected systems, preserve forensic evidence, restore from clean backups, and coordinate with your bar association notifications and any outside counsel you retain. We also coordinate with your cyber liability carrier. The goal is to minimize harm and produce a clean record of how the incident was handled.
Can you help with e-discovery and legal holds?
Yes, we manage the technical side of preservation, including litigation hold notices to your systems, immutable backup retention, and chain-of-custody documentation. We work with the e-discovery vendors and outside counsel you select for the legal-strategy side.
How do you handle data sovereignty and cross-border concerns?
We work with clients that have international components, and we structure their data architecture to keep regulated data in the appropriate jurisdiction. Microsoft 365 and Azure offer regional data residency that we configure on your behalf.

Service & Support

Do you provide on-site support, or is everything remote?
Both. For Southern California clients, we're often on-site weekly or as projects require. For clients elsewhere, we have a network of vetted technicians in major metropolitan areas, we've been on-site in Atlanta, Phoenix, Dallas, Houston, and a long list of others. Most day-to-day support is handled quickly and remotely, with on-site visits whenever they're the right call.
What are your service-level agreements?
For Unlimited Help Desk clients, P1 issues (firm-wide outages) get a response within 15 minutes during business hours and within an hour outside business hours. P2 issues (individual user, work-blocking) within an hour during business hours. We share full SLAs in your proposal.
Who actually answers when we call?
A technician. Not an answering service. Not a chatbot. We're not a managed-services factory; we're a small firm by design. If you've worked with us a while, you'll know your technicians by name.

What does AgileEM cost?
Our pricing is standard and published on our Services page. Essential IT is $79.95 per workstation per month. Unlimited Help Desk is $99.95 per person per month. Physical office locations add a network charge of $25 to $200 per location per month depending on complexity; remote employees working from home don't count as a location. Do you only work with law firms?
Law firms are the heart of our practice and the focus of our methodology. We also support a small number of professional services firms, accountants, financial planners, and similar practices, where the confidentiality and compliance posture is comparable.
Are you familiar with the practice management software we use?
Likely yes. We've worked with Clio, MyCase, PracticePanther, Smokeball, Filevine, NetDocuments, iManage, Worldox, and a long list of others. We don't sell practice management software, we support the one you've chosen.
How do you handle conflicts of interest between firm clients?
We don't take on engagements that would create an obvious conflict, for example, two firms in active litigation against each other. When in doubt, we'll flag it during intake and let you decide.
Can you support multi-office firms?
Yes. We currently support firms with multiple offices in California and other states. Our Custom Flat-Rate engagement is often the right fit for these practices.

Data Retention

We keep personal information only for as long as needed to fulfill the purposes described in this policy, to meet our contractual obligations to clients, and to satisfy legal, tax, accounting, and recordkeeping requirements. Inquiry and marketing records are generally kept for up to twenty four months after your last interaction with us unless you ask us to remove them sooner. Client service records are generally kept for the life of the engagement plus seven years. When information is no longer needed we securely delete or anonymize it.

California Privacy Rights Under The CCPA And CPRA

If you are a California resident, you have the following rights regarding your personal information.

  • The right to know what categories and specific pieces of personal information we have collected, the sources of that information, our purposes for collecting it, and the categories of third parties with whom we share it

Program Name And Description

The program is called AgileEM Client Messaging, operated by Agile Enterprise Management, Inc. When you give consent, we send text messages to the mobile number you provide for the following purposes.

  • Replies to inquiries you submit on AgileEM.com
  • Appointment scheduling, confirmations, and reminders for consultations and on site visits
  • Help desk and service ticket updates, including status changes and requests for information
  • Time sensitive service notices such as outage, maintenance, and security incident alerts
  • Occasional account and service related updates for existing clients

We Do Not Sell Or Share Your Mobile Opt In Data

Mobile phone numbers and text messaging consent collected through this site are never sold, rented, leased, shared, or transferred to any third party or affiliate for marketing or promotional purposes. No exceptions.

Who Can Receive Your Mobile Information

No mobile information is shared with third parties outside of the service providers strictly needed to deliver the messages, such as our messaging platform and telecommunications carriers.
